Tragic bus accident caused by an illegal alien without a valid drivers license

According to this story in the Star Tribune today, the driver of the van that hit the school bus did not have a license.

Not only that, the driver pleaded guilty to driving without a license and paid a fine in 2006. How does a person get a car to drive without a valid license? Why isn't there more enforcement by local law enforcement over people who have been found guilty of driving without a license? We make sex offenders register and notify communities about where they live. Why isn't more done to enforce the laws which require you to have a valid drivers license to operate a motor vehicle? Something needs to change so the death of these four children is not in vain.

We now know that the driver of the van who killed the four kids on the bus is Aliannis N. Morales (not her real name) and she is an illegal alien. How does an illegal alien get a MN identification card? I understand the law changed in 2006 after she got her card, but I am embarassed for my home state of MN that our laws in 2005 or 2006 or whenever she got the card would allow an illegal alien to obtain a MN identification card. Now four kids are dead. Something better change.

Do you know that Minneapolis is a so-called "sanctuary city"? Sanctuary cities are cities where local law enforcement is barred from so much as asking the people they come into contact with about their immigration status. As a consequence, these cities are able to evade their legal responsibilities to share such information with federal authorities. This is increasingly important as 40 percent of the current illegal population entered the U.S. legally and simply overstayed their visas. This means that even if we had the best border security in the world, we would still have an illegal immigration problem. Federal law needs to be changed to require these so-called sanctuary cities to allow their law enforcement to inquire about immigration status when questioning someone who has committed a crime.

In his blog on the Marshall Independent's website, editor Dana Yost wrote Friday: "We've gotten e-mails and phone calls from around the country, most of them angry and demanding that someone do something about the woman. ...

"I told one e-mailer that far more people are killed by drunken drivers in Minnesota than by illegal-immigrant drivers. If we devoted as much energy to keeping drunks off the road as many are howling now about illegals, that might be a little more productive."

Great point about drunk drivers -- one that has recently been illustrated in our community. In July of 2006, a drunk driver hit a Savage police officer on Highway 13 as the officer was talking with a motorist he had just pulled over. He was caught, his BAC was .10, and he has yet to go to trial. In November 2007, that same driver hit and killed Nichole Andersen in Scott County. According to police, he was .07 at the time and his omnibus hearing is next week. The accused man's attorney has slowed down the legal process based on the "source button issue" defense. That type of defense challenges the BAC results based on the fact that the manufacturer of the machine will not divulge the code that comes up with the alcohol reading.

Actually, it's a pretty poor point.
We do spend an large amount of time and energy on DUI enforcement. Setting up stops, paying for extra officers and any time a police officer makes a routine traffic stop, if he suspects someone is DUI, they will test them.

Not so with illegal immigration.
And if you think it is not an issues, spend 5 minutes talking to the Scott country attorney and ask him what is filling up the dockets in Scott County and filling our Jails. It is illegal immigrants committing serious crimes.
Which is sad in Scott county which has a large and vibrant legal immigrant community.

Criminal immigrants should be treated as such, criminals. I find the irony of our lefty friends, who take every opportunity to over regulate us (see the latest drive to require all vehicles have backup lights) because it could save "one life", but this is over reacting.
Or the fact that our DFL representative in Savage, Will Morgan is happy to put this state into economic ruin because of 13 deaths in I-35, but wanted no part of any enforcement against criminal aliens after the death of 4 children.

The righties would blame the people who cause the problems, whether they be conservatives, liberals, legal or illegal immigrants, etc. We're about personal responsibility, remember? It's the lefties that are all about no-fault living.

Ramming in to a bus and k i l l i n g four children is a little more than a traffic a c c i d en t . It is vehicular homicide. It is the m u r d e r of four children. If the crime had been committed by a legal immigrant or US citizen, I would still be outraged. What makes this crime more painful is that it never would have happened if the illegal immigrant in this case had been deported or never come to this country in the first place.

I am sick and tired of hearing about the rights of illegal immigrants. They are here illegally. They are breaking the law. They do not have rights as a US citizen has rights. They have rights to humane treatment and perhaps a free trip back home. Other than that, they have no rights. There is a process by which you come in to this country legally. If you don't follow that process, you should be deported.

Also, companies that employ illegal immigrants should be severely punished for enabling and perpetuating the problem.

The debate about illegal immigration is one that reasonable people should be able to have. The discussion certainly involves a lot of issues. I don't have a problem engaging in a debate about what the best solution might be - if there is one. What I have a problem with is people trying to exploit a tragic situation like this bus accident in an attempt to further their narrow point of view.

I also have a problem with people who seem so comfortable sitting back - now that they're in this country - saying we should build a wall and keep everyone else out. What would you do if you and your family were struggling to survive amid horrible conditions in another country? It sounds easy to say, "Follow the rules, wait your turn" etc. But the LEGAL immigration system in this country is broken. It takes years to get in legally. I'm not condoning illegally entering this country or any other, but I can at least appreciate and understand that when people are faced with desperate circumstances, they might resort to desperate actions to help themselves or their family to a better life.

This is a nation of immigrants. To paint all of these people as "criminals" is un-American in my opinion.

You are entitled to your opinion. That is one of the great facets of this country.

Another great thing about this country is we are a nation of laws. Illegal immigrants broke the law and they are therefore criminals. That is not an opinion. It is a fact. If you want to change the laws, lobby your legislators but don't call it un-American to call people criminals who break the law. I think you are un-American in your views and you know what, I am entitled to my opinion also. What a country.

"The driver has been identified as Olga Marina Franco and she's from Guatemala, according to Gail Montenegro, a spokeswoman for U.S. Immigration and Customs Enforcement (ICE) in Chicago.

Franco has been charged with four counts of criminal vehicular homicide stemming from the Feb. 19 crash near Cottonwood. Witnesses say she blew through a stop sign, jumped over some railroad tracks and hit the rear of the bus, which tipped over and collided with a pickup truck.

The woman initially said her name was Alianiss Nunez Morales, but ICE officials said she was using a fake name and was here illegally."

Interesting article in the Strib this past weekend about unlicensed drivers. Apparently there are quite a few of them driving around out there. Drivers beware! Drive defensively!

If a person doesn't have a driver's license and are caught driving, they obviously should be ticketed accordingly. In this day and age, why would it be so hard to run an immigration check on the law enforcement computer in the squad car at that point? I understand we probably aren't "wired" for it right now, but how hard can it be?

Guess what? It's not working. Need proof? Check the police reports in Savage, Prior Lake and other communities in the Twin Cities. Every week, there are people - quite a few people - driving around with blood alcohol contents two and three times the legal limit (one of them just hit a Prior Lake squad car last month). For many of them, it's not the first such offense. And not having a driver's license doesn't seem to stop any of them, whether they're immigrants or not.

Not to disagree Lori, but actually that even proves my point further.

I don't think you are implying that since we have implemented stronger DUI law and enforcement that rates have gone down (I don't have the stats handy now, but can get them). But you are correct that after you increase enforcement, you reach a point of diminishing returns no matter how much money you throw at an issue.

But I am sure that you would agree that if Savage were to pass a DUI sanctuary law - where if you were stopped in Savage for reckless driving that the officers were prevented from inquiring about you consumption, that it would not decrease the number of people driving while intoxicated?

The problem is not with the Police, but with the bureaucrats and judges who are not caring out the enforcement and incarceration on both these issues.

Will Morgan Supports Illegal Immigration -

Today in the house in addition to voting against property tax relief, Will Morgan also voted against preventing "sanctuary cities".

Interesting as I was having dinner they were interviewing police officers in border states who were begging their cities to allow them to call ICE.
But in MN they get no such support.
Apparently Will thinks it is more important to keep these folks on the road.

Yes, Morgan's vote was essentially a swing vote as the proposal failed by only one vote. The proposal would have withheld state government aid from cities that prohibit police from checking the immigration status of people. It was rejected 67 to 66. There is another proposal in the House that would prohibit cities from barring officials from cooperating with federal agents on immigration investigations. Call your legislators and tell them how you feel!

I really can't believe this case is being blamed on a person's lack of citizenship. Blame it on the person's lack of a driver's license, driving ability, drinking/drugs/whatever. But what exactly does being a citizen of the United States or not being a citizen of the United States have to do with this woman causing this accident? It doesn't matter which side of the immigration fence you're on. The simple fact is, people who are citizens of this country drive without licenses, drive drunk, etc., too. And there are far more of them.

Exactly, it's a simple matter of cause and effect. If she were not in the country, those kids would still be alive.

The fact that she is an illegal alien makes the deaths that much more cruel because it would not have happened if she had been deported when she was cited for no license two years earlier. Now you have finger pointing going on between local law enforcement and federal immigration officials with both sides blaming the other for the lack of deporting of discovered illegal aliens. They had better start working together going forward.

I'm not arguing your point that had the woman been stopped earlier she wouldn't have been around to cause the crash. I'd prefer to stay out of the immigration debate on this Web site.
I'm simply saying, if it wasn't that particular woman who hit the bus, it's just as likely someone else - someone drunk or high or otherwise unqualified to drive who IS a citizen of this country - could have taken her place.

If there's a will there's a way ... it's human nature. If someone wants to drive without a license they will -- no matter if they don't have a license because they've been ticketed multiple times for drunk driving, had too many speeding tickets or because they are an illegal immigrant. I agree, there's something seriously wrong with the system if cops in Minneapolis and St. Paul cannot ask a driver their legal status because they are in some imaginary "santuary." Unfortunately, we all let the children on that school bus in Cottonwood down.

Lori,
Based on that logic (another driver could have done), we should bother being concerned with drunk driving - because someone else driving badly could have caused an accident.

And the immigration debate is very important to Savage and Scott county.
If you have a chance talk with some of the Scott County Sheriffs or the Attorney's office, they will tell you about the stories of the negative impact of illegal immigration on the area from crime to drugs.

It is also a big concern here in this area because we have such a strong legal immigrant community that deserve respect for following the law. And we should be enforcing the rules they obeyed as a sign of that respect.

Thank you for the clarification, but I don't need a deep, calming breath. The context of what you wrote suggested to me that you were talking about "us", not just "you". Now I know differently.

As Robert T. points out, your argument seems to suggest we do nothing about anything because someone else would step in and commit the sin. Pretty faulty logic especially in this case where it's quite a stretch to suggest that someone else would have rammed that bus on that day and killed those kids.

I see one of Senator Norm Coleman's planks in his re-election platform is to eliminate so-called sanctuary cities. Hurray for Senator Coleman! There should be no city or town that is able to prevent their police officers from helping to detain and deport illegal aliens. There are plenty of people waiting in line to come in to the country legally. Those who do so illegally should be punished under the law. Also, people and companies who employ illegal aliens should be punished under the law. If the demand for the cheap labor dried up, there would be less incentive to come here illegally.
